development of a project for a Multilateral Convention on Social Security was agreed upon. 

Subsequently, the Final Declaration of the XIV Ibero-American Summit of the Chiefs of State and 

Government, which took place in Salamanca (Spain) on the 14th and 15th of October, 2005, 

establishes in section 17 the decision to “initiate the process of elaboration of an Ibero-American 

Convention on Social Security with the objective of guaranteeing the Social Security Rights of 

migrant workers and their families”, a commitment which was reiterated during the XV Ibero-

American Summit, (which took place in the city if Montevideo on October, 2006) which established 

“adopting all necessary measures to promptly and adequately make the Convention come into effect”. 

At the regional level, one can point out precedents of bilateral order, such as the Multilateral 

Convention on Social Security of MERCOSUR and Decision 583, Andean Instrument of Social 

Security, in their corresponding periods of effect.  

After two years of work, the General Ibero-American Secretariat (SEGIB) and the Ibero-

American Organization on Social Security (OISS) took their Convention Project to the Ministerial 

Conference on Social Security, from which it was elevated to the Summit of the Chiefs of State and 

Government of Santiago, Chile (November, 2007). Here, unanimously, the text of the Convention 

was adopted and the commitment to “impel internal procedures to promptly make it come into 

effect”

 was undertaken. 

C. General Aspects 

First of all, it is necessary to indicate that the Convention is a norm that can be used to set a common 

ground for the legislation on Social Security of the countries that have not yet ratified it; but it does 

not imply a modification, or even an alteration of the internal legislation. These are respected by the 

Convention in their entirety. 

Before delving in the analysis of some technical elements of the Convention, some general 

characters and principles found in the Convention must be established:  

a.  It establishes the Principle of Equal Treatment towards nationals of countries belonging 

to the Ibero-American Community, included in the field of personal application within 

the Convention; 

b.  It includes workers that develop dependent or independent activity, legally; it´s family 

and survivors, which is analyzed within the personal field of the Convention; 

c.  It issues old age and disability benefits, death benefit payments, and other economic 

benefits that might derive from similar situations in accordance with national legislation, 

including industrial accidents and professional illness; 

d.  It guarantees the rights on the verge of acquisition through the totalization, if 

necessary, of the periods of insurance, employment, or residency, according to each 

individual case under the legislation of the different States, without prejudice to the 

calculations of the benefits in proportion to the effective insurance, employment, or 

residency in each of the States;
