bilateral agreements and/or employment contracts

3. Rapporteur´s Summary of the Working Table on “The  

human rights, labor rights, and risks associated  

with temporary migrant workers”, Ernesto Nosthas 

Member countries of the RCM can rely on local legal framework, which is a good starting point 

towards guaranteeing labor rights of temporary migrant workers. From that, efforts of self-revision 

can be made to update the normative framework of such subjects in relation to the realities of labor 

rights of temporary migrant workers. Additionally, a great challenge arises in ensuring recognition, 

documentation, and information dissemination on temporary migration and the rights of those who are 

participants in the process. It is very useful to develop a culture of denunciation within migrant 

workers in all stages of the migratory cycle.  

A space to take action is opened for State governments, reaching outside their boundaries to 

monitor the respect of their migrant worker’s labor rights, strengthening the Consular and Diplomatic 

representations by means of labor specialists with international experience, with the support of an 

inter-sectorial group from the country of origin. These specialists will not only provide support, be it 

direct or indirect, to the workers, but also they may serve as the basis for the certification of 

businesses in the country of destination. The process of certification will be granted to those private 

entities that demonstrate social responsibility towards their migrant workers. These efforts should not 

be estranged from the support that the private sector may offer and should be carried out in 

coordination with the private sector itself. In this way, an outline for supervision of rights is offered, 

with the participation of multiple actors – which include labor unions and other organizations of civil 

society, avoiding penalty measures which are not always effective.  

On behalf of receiving countries, the creation of quick and effective processes of 

documentation is necessary to guarantee a legal framework for protection of migrant workers. To 

carry this out, proper resources must be allocated so that government institutions respond with the 

service demands, so as to provide effective response in accordance to the productive needs of the 

countries; including supervision and verification of proper conditions. The new law of the Province of 

Manitoba, Canada, stands out in this particular since it has even included cautions and guarantees for 

the businesses hiring International labor. In some cases, the interconnection between Migration 

Offices and the Ministry of Labor make quick migratory processes more feasible. Mexico’s 

experience, exempting migrant workers with minimum wages from the costs of their regularization 

documents, was also acknowledged as a best practice.  

On the issue of strikes, the group’s conclusion was that a deeper more detailed investigation is 

needed in order to find ad hoc solutions, perhaps through case studies – an example of this is the 

establishment of warranty bonds on behalf of the businesses. Regarding strikes in destination 

countries, some places have provided an effective response through the creation of a solidarity fund to 

support protection cases.
